As Pride Month draws to a close, we at Pantheon Chambers reaffirm our commitment to equality, dignity, and justice for all.
We are proud that our Azan Marwah continues to play a key role in pushing the boundaries of constitutional and family law in Hong Kong. Earlier this month, he appeared for the child (led by Nigel Kat SC) in a landmark case advocating for the rights of same-sex couples to found a family via reciprocal IVF – a case that speaks directly to the values of inclusion and human dignity.
As Azan told the court, “Same-sex couples should have the right to found a family.” This is more than a legal argument; it is a reflection of the principles that should guide a just society. Azan also argued that guardianship orders, while available, do not fully address the legal and practical gaps faced by same-sex parents – in the event of separation, the non-biological parent couldn’t claim maintenance, while the child would face a “lifelong disability” by being unable to inherit under Hong Kong’s intestate laws.
