Romain recently acted as sole advocate for the defendant charged with indecent conduct toward a child under 16 years old (under s.146 Crimes Ordinance) in a 3-day trial.
The accused was confronted with serious allegations of indecent conduct toward a child under 16 years old. Romain successfully secured him a release on bail despite strong opposition from the prosecution.
Given the sensitive nature of the case, a thorough investigation should be conducted. During the trial, Romain contested several prosecution applications, including attempts to present exhibits to witnesses without a solid justification and the admission of a cautioned statement acquired under questionable circumstances. The defendant was consequently acquitted and awarded costs.
While the case underscores the ethical concerns, effective criminal defence plays an essential role – scrutinizing the prosecution's case and providing alternative views, is crucial for upholding the presumption of innocence, the fundamental principle of our legal system.
