Case Update - HKSAR v Wong Ying Hung KTCC 1927/2024

Aria acted as a sole advocate for the Defendant at PTR and at trial in Chinese, where the Defendant, a construction worker, was accused of kicking and scraping the complainant's shin during an altercation. The Defendant claimed self-defence, stating that the complainant initiated the conflict by hitting him with a cement trowel.


The Defendant, a construction worker, got into an altercation with a fellow worker at a construction site. It was alleged that the Defendant had kicked and scraped the complainant’s shin as they struggled to the floor. The Defendant averred that it was the complainant who had hit the Defendant on the left forehead with a serrated cement trowel first, leading to the Defendant having to defend himself.


Under cross examination, the complainant had claimed that the trowel he held was actually different from the one collected by the police, and that the injury to the defendant’s forehead was caused by his falling backwards onto a metal workbench. The Defendant was ultimately acquitted upon the learned Magistrate’s finding that the complainant’s evidence was incredible.
