Case Update - [2024] HKDC 1572; DCCC 1193/2023

Dangerous driving causing death is a serious offence.


In this case, the first defendant was involved in a serious traffic accident. He was charged with dangerous driving causing death, after colliding with a taxi while speeding at over 117 km/h in a 50 km/h zone, which led to a secondary collision with a public minibus. Tragically, this accident resulted in the death of his friend, who was a passenger in his vehicle and injuries to others on the public minibus.


Our member, Becky So, represented the first defendant as sole advocate in his mitigation, highlighting that he expressed deep remorse for causing the death of his friend, as well as his own serious injury from the accident. The first defendant also contributed to charitable donations for the elderly, in addition to entering an early guilty plea. Although he had prior traffic violations, including speeding, he was sentenced to 14 months imprisonment after a one-third deduction for his early guilty plea, along with disqualification of his driving license for 5 years (minimum disqualification requirement for this type of offence).
