Contribution to Hong Kong Civil Procedure - Special Release to the 2024 Edition

Edward, a regular editor of the Hong Kong Civil Procedure (“White Book”), has once again made a remarkable contribution to the book this year, collaborating with Arthur Wan, his mini pupil.

In the chapter they have worked on – “𝗘𝘅𝗰𝗲𝘀𝘀𝗶𝘃𝗲 𝗜𝗻𝗱𝗲𝗺𝗻𝗶𝘁𝘆 𝗖𝗼𝘀𝘁𝘀 𝗶𝗻 𝗣𝗿𝗲-𝘁𝗿𝗶𝗮𝗹 𝗗𝗶𝘀𝗰𝗼𝘃𝗲𝗿𝘆 𝗔𝗽𝗽𝗹𝗶𝗰𝗮𝘁𝗶𝗼𝗻𝘀: 𝗔 𝗕𝗮𝗿 𝘁𝗼 𝗝𝘂𝘀𝘁𝗶𝗰𝗲?” – they discussed the current landscape of pre-trial discovery applications and raise pivotal questions surrounding the disproportionate burden of indemnity costs. They examined that the current approach, which places a heavy emphasis on indemnity costs in such applications, may unintentionally prevent access to justice for plaintiffs and create an imbalance in the legal field.
