The proceedings were issued by the Plaintiff over the correct interpretation of the Deceased's will, who was the father to the parties. Father's will provided, inter alia, that his children will cease to be beneficiaries if they fail to comply with customary rituals burying him after he passes. The Plaintiff further sought to remove the named executrix from Father's estate, the 1st Defendant. The 2nd and 4th Defendant acted in person and did not take part.
The trial dealt with the detail father's funeral in Hong Kong and in mainland China, where Father was buried. Despite the Defendants' allegation that the arrangements were not compliant with the will, the Court found for the Plaintiff that Father's will was complied with by the parties. The Court further found in favor of the Plaintiff that the 1st Defendant had failed to render proper accounts and inventory of Father's estate and had intermingled her own funds with Father's estate. She was therefore removed as executrix and orders directing parties to appoint a suitable administrator were made.
