Shing Yat Kwong v. Li Man Hong and Another [2023] HKDC 97

The plaintiff alleged that the defendant’s structures encroached on parts of his land and therefore sought, inter alia, a mandatory injunction to demolish said structures and recovery of vacant possession of the encroached areas. The Defendants denied any encroachment, and even if there was, relied on defences in acquiescence, estoppel, implied licence, agreement and de minimis.  The Court rejected all the defences and granted relief sought by the plaintiff.
